About SIPSY. 

We are SIPSY. (VL Adams-Houldsworth & RJ Lancaster trading as SIPSY. ABN 65 671 927 161) and we hold Liquor Licence number LIQP770017716.

  • We’re here to help promote local producers of good quality Aussie products and encourage more people to sip local through our various Services.

About these terms

1. Who do these terms apply to?

These Site Terms apply when you buy products from us or visit our Sites which includes our website (sipsy.com.au) and includes our mobile apps & presence on third-party applications as well as social media platforms, such as Instagram (@sipsy.drinks).

  • You must be over 18 to access our Site.
  • If you don’t agree to our Terms or you are under 18, that’s okay, but you must stop accessing and using our Sites.

Buying products from our Site

2. Ordering from us

Liquor products are sold from our Site by SIPSY. under our Liquor Licence, with the sale for liquor products being made at the licensed premises attached to our Liquor Licence.

  • You must be 18 or over to buy alcohol from us (that’s the law!)
  • If you can’t confirm you’re 18 years or over, we won’t process your order.
  • When you place your order, you confirm to us that all information you give us is true.

Delivering products to you

3. Charges for delivery

Delivery charges may vary depending on what you’ve ordered and the delivery address.

  • Once we dispatch your order, we cannot make changes to delivery address or other details. Extra charges might apply for changes to your order after we’ve dispatched it.
  • If you provide an incorrect address so that we need to re-deliver, we charge you a reasonable re-delivery fee ($20).

4. Getting your products to you

We’ll deliver your orders promptly within 7 to 10 business days from when you order them.

  • Delivery instructions from you are a guide for our delivery partners only, we can’t guarantee they’ll be followed exactly.

5. Responsible Service of Alcohol

We might need to ask for proof of age when the products are delivered.

  • We can’t leave products at the delivery address with someone who is unable to produce proof they are over 18, even if you gave authority to leave when the products were ordered.
  • We’ll leave a card with instructions for collection and take the products to a collection point where they can be collected with appropriate proof of age identification.

We won’t deliver products to you if we are concerned you show signs of intoxication

  • If your order is cancelled because you don’t have proof of age or you show signs of intoxication, we will refund the cost of the order except for a delivery fee which will be charged.

6. If you aren’t at home to receive the products

  • If you are not at home, we’ll leave your products in a safe location if you instructed us to do so or leave a card with directions for collection.
  • SIPSY. and our delivery partners are not responsible for any missing products if you give us the authority to leave products without a signature. 

Returning products and refunds

7. Let’s talk if something isn’t right

If you have an issue with our products or services, we hope you’ll work with us so we can help resolve that issue. 

  • Please contact us via email and include the following information so we can help resolve your issue:
    • Details of the issue;
    • How we can help you resolve the issue; and
    • Relevant information (such as pictures and copies of your proof of purchase).
  • We’ll confirm we received your complaint within 5 business days and work to investigate and resolve your issues within 30 days.
  • If we can’t resolve your issue after this, we will be in touch to set out some proposed next steps.

8. You have rights under Australian Consumer Law

If you buy products from our Site, you have rights under the Australian Consumer Law. These Terms do not try to override those rights.

  • If your purchase is faulty, damaged, incorrectly described or breaches a consumer guarantee we will refund your money or exchange the product.
  • We generally do not offer returns, refunds or exchanges for ‘change of mind’.
  • For a full refund on orders where we are at fault, you must provide proof of purchase and the products must be in their original condition (i.e. unopened!)
  • If your purchase involved delivery charges, then we will cover the cost of delivery for the return if we are at fault.
  • We are at fault if the wrong product is delivered, there is a fault with the product (including any damage caused in transit) or we breached a consumer guarantee.

About our Site generally

9. Security

We have systems & processes to store + manage info, but in general the internet and our Sites may not be 100% secure.

10. Copyright and intellectual property

  • We own all intellectual property rights in all content (images, video, text, logo, digital downloads, etc) on our Sites or have appropriate licences in place.
  • You must not use our Site or content in a way that competes with our business or breaches our IP rights.
  • Unless we give you permission, you must not sell or otherwise re-use our Site content.

11. Limiting our liability

We do what we can to keep our Sites up to date however we’re not liable for any errors or omissions on our Sites.

  • Recommendations we may offer are general in nature, and not tailored to you or your circumstances
  • We’re not responsible for Site content generated by other users (such as comments).
  • To the extent allowed by law, we are not responsible for any loss or damage arising from or in connection with your use of our Sites.

12. If you cause us loss or damage, you’ll need to compensate us

You must pay us for any loss or damage you cause us that arises from your use of the Site or your breach of these Terms (such as misusing our content or giving us false information).

13. Privacy and your personal information

How and why we collect, use, and share your information, is detailed in our Privacy Policy, available on our Site.

14. Content you post to our Site

If you post content to our Sites, you grant us a broad global, royalty-free licence to use that content as we see fit.

For example, reposting positive comments or social media comments you make about us.

15. Affiliate links

We have partnerships with some third parties who offer products and services we love. Some of the links on our Site are affiliate links. This means we may earn a small commission if you purchase after clicking on these links.

16. Buying from us

When you buy products or services from us, or become our customer, other terms and conditions we agree with you will apply in addition to these Site Terms.

17. Accessing the Site

We do not promise our Site complies with any laws outside New South Wales or outside Australia. If you access our Site from outside Australia, you do so at your own risk. You are responsible for following the laws that apply where you access our Site.

18. Changes to these Service Terms

From time to time, we may change these Site Terms without notice to you, so check them when you visit to make sure you’re still happy with them!

19. Governing law

The laws of the State of New South Wales, Australia govern these Terms.
